ISLAMABAD: In a recent development, the National Industrial Relations Commission (NIRC) in Islamabad witnessed Case No. 7(61)/2023, where Moazam Javed Khokhar and others brought a complaint/contempt application against M. Asim Khichi, the Managing Director APP. The case was presided over by Senior Member Noor Zaman.
The background of the case revolves around an order issued by the NIRC on August 7, 2023, directing the respondent to refrain from passing any adverse order concerning the petitioner’s service. Additionally, the order specified that the petitioners should be allowed to continue their duties without interruption and their salaries should not be stopped.
However, as per the complainant’s advocate, Mr. M. Akhtar Anjum, the petitioners have been denied the right to perform their duties, a direct violation of the aforementioned order issued by the Bench.
The application sought to summon the respondent, M. Asim, and to hold them accountable for their failure to comply with the NIRC’s order. In light of this, the Bench has issued a notice to the respondent, calling them to appear before the Commission. The respondent is expected to provide an explanation as to why they have not adhered to the order and why no action should be taken against them under Section 57(1)(b) of the IRA, 2012.
The respondents have been given until August 24, 2023, to appear before the Bench and address the concerns raised. This case highlights the NIRC’s commitment to upholding its orders and ensuring compliance with the labor laws of the country.
